III.5. Monitoring and enforcement
The Supplier reserves the right to monitor use of the Platform for compliance with these Terms. Where the Supplier reasonably determines that the User has breached these Terms or applicable law, the Supplier may suspend or restrict access to the Platform, request corrective action, or terminate the account in accordance with these Terms. Such actions shall not give rise to any liability on the part of the Supplier.
IV. Data aggregation and enrichment
Queast provides access to information that is collected, aggregated and derived from publicly available sources and third-party data providers. Such information may include, without limitation, job advertisements, company-related data, organizational and role-based information, technology indicators, and other market signals made publicly accessible by third parties.
The Supplier does not access, collect, or process information from sources that require registration, login credentials, or circumvention of technical or contractual access restrictions, nor does it process information designated as private or restricted by the relevant platform or individual.
Any references to identifiable individuals made available through the Platform are strictly contextual and auxiliary to the analysis of job ads, hiring signals, or company profiles. IV.1. Data aggregation and enrichment process
Queast applies automated analytical and enrichment processes to aggregated data in order to identify patterns, extract insights, and present structured intelligence to Users. These processes may include categorization, correlation, scoring, and other analytical techniques. Such processing does not alter the original ownership of the underlying data and does not imply endorsement or verification by Queast.
The enrichment performed by Queast is intended to improve usability and analytical value and does not constitute factual assertions about any individual or organization. Any interpretations, classifications, or insights generated through the Platform are inherently probabilistic and may be subject to error.
IV.2. Ownership or exclusive rights
All third-party data made available through the Platform remains the property of its respective owners. Nothing in these Terms shall be construed as granting the User any ownership rights, intellectual property rights, or exclusive rights in or to such data. The User is granted a limited, non-exclusive, non-transferable, and revocable right to access and use the data solely through the Platform and strictly in accordance with these Terms.
IV.3. Accuracy, completeness and timeliness of the data
Queast does not independently verify all aggregated or enriched data and provides the data on an “as-is” and “as-available” basis. The Supplier makes no representations or warranties regarding the accuracy, completeness, reliability, legality, or timeliness of the data. The User acknowledges that data may be outdated, incomplete, or inaccurate and agrees to independently verify any information prior to reliance or use.
IV.4. No responsibility for Third-Party content
All data, information and content originating from third-parties, including but not limited to job advertisements, company descriptions, organizational details, and any related materials, are provided through the Platform solely as aggregated or processed information obtained from external sources. Queast does not create, control, influence, or approve the original content published by third-parties and does not assume any responsibility for such content.
The Supplier does not guarantee that third-party content is lawful, accurate, complete, up to date, or compliant with any specific legal or regulatory requirements. The inclusion or availability of third-party content within the Platform shall not be construed as an endorsement, verification, recommendation, or approval of such content, nor as any form of partnership, affiliation, or association between Queast and the relevant third party.
User acknowledges that the Platform may provide access to data that originates from third-party sources that are subject to separate terms and conditions. The Supplier does not warrant that any use of such third-party data complies with the terms under which it was originally provided to Queast, and the User shall not hold the Supplier liable for any claim arising out of any third party’s terms, conditions, or restrictions.
The Supplier shall not be liable for any loss, damage, claims, fines, or liabilities arising out of or in connection with third-party content, including any reliance placed upon such content by the User, any errors or omissions contained therein, or any use of such content by the User for commercial, marketing, or other purposes. Any interaction, reliance, or engagement with third-party content is undertaken entirely at the User’s own risk.
V. AI functionalities
The Platform includes AI-assisted functionalities, including, without limitation, features such as “Generate an Outreach Message”, enrichment and suggestion features (the “AI Features”). The AI Features generate outputs by analysing and combining data aggregated by Queast, company information and contextual inputs that a User supplies to their account as well as structured or free-text prompts or instructions that the User elects to submit.
The AI Features may be implemented using models developed and hosted by Queast or using third-party model hosting or inference services. Irrespective of the hosting arrangement, Queast retains control over the processing of User prompts and account inputs for the purposes set out in these Terms and the Privacy Policy and will not disclose prompts or User-provided inputs to third-party model providers for their independent training or other reuse.
V.1. Prompts, user inputs and prohibited content
Users may supply structured inputs or free-text prompts to the AI Features to guide content generation. Users must not submit confidential information, personal data or special-category personal data through prompts or otherwise. The User shall not use the AI Features to generate content that is unlawful, defamatory, discriminatory or otherwise contrary to applicable law. The User remains solely responsible for the content of any prompts provided and for verifying, editing and approving any AI-generated message prior to sending or publishing it.
Queast does not use User prompts, AI-generated outputs or any other User-provided inputs to train, fine-tune or improve its underlying AI models or models of its third-party providers. All processing of User data for AI Features is performed solely to provide the service to the User in the immediate context. Queast maintains a strict separation between User-specific data and its core algorithmic architecture to ensure that no data leakage occurs.
V.2. User control and informational nature
All output content generated through the AI Features is provided solely as a non-binding suggestion and for informational purposes only. The User retains full control and discretion over whether to use, modify, send, or discard any generated content.
Queast does not review, validate, approve, send, or monitor any outreach messages and does not participate in or influence the User’s communication with third parties. The User remains solely responsible for the final content of any message and for any decision to send or not send such message.
V.3. Liability
The User acknowledges that AI-generated outputs may contain inaccuracies or omissions. The User is solely responsible for reviewing and approving the AI-generated content. The Supplier shall not be liable for the content, accuracy, legality, or consequences of any AI-generated outreach message, nor for any claims, damages, fines, penalties, or losses arising out of or in connection with the User’s use of, reliance on, or transmission of such messages.
Any outreach conducted using AI-generated messages is performed entirely at the User’s own risk and responsibility.
VI. Subscriptions, fees and payment
Access to the Services is provided on a monthly or yearly subscription basis in accordance with the subscription plan selected by the User. A one-off starting fee is applicable at the start of the first subscription period for the purposes of custom profile setup, applicable configurations, integrations and onboarding. Each subscription grants the User a limited right to access and use the Platform and the Services during the applicable subscription term, subject to the usage limits, features, and conditions associated with the selected plan.
Unless expressly agreed otherwise in writing, subscriptions are provided for the selected initial term followed by recurring renewal periods, as further described below. Access to the Platform is conditional upon timely payment of all applicable fees.
VI.1. Free trial period
The Supplier may, at its discretion, offer the User a trial period granting access to certain functionalities of the Platform at a discounted subscription fee or free of charge.
During the trial period the User may use the Platform solely in accordance with these Terms and the scope of access communicated by the Supplier. No subscription fees shall be due for the duration of the trial period.
The User may cancel the trial at any time up to and including the last day of the trial period, in which case no fees shall be charged.
Unless the User cancels the trial prior to its expiration, the trial shall automatically convert into a paid monthly subscription, and the User shall be charged the applicable monthly subscription fee in accordance with the applicable pricing and billing terms.
VI.2. Ongoing subscription
The subscription shall automatically renew on a rolling basis under the same subscription plan for a new monthly or yearly period unless the subscription is terminated in accordance with Section VII (Termination) of these Terms.
Each renewal constitutes a new billing period for which the applicable subscription fee according to the subscription plan shall be due and payable in advance. Continued access to the Platform during any renewal period is conditional upon payment of the subscription fee for the renewal period.
VI.3. Fees and pricing
The applicable subscription plans and the monthly/yearly fees for each plan are those communicated to the User at the time of subscription or as otherwise agreed in writing.
The Supplier reserves the right to modify subscription fees or introduce new pricing models, provided that such changes shall not apply retroactively and shall take effect from the next renewal period following reasonable prior notice to the User.
VI.4. Invoicing and payment method
The Supplier issues invoices for each subscription period. Unless otherwise stated on the invoice, all invoices are payable by bank transfer to the bank account specified by the Supplier, within the payment term indicated on the invoice.
The Supplier shall send an invoice to the User for payment of the subscription for the next period at least 7 (seven) days prior to the expiry of the current subscription period.
In case the payment for the new subscription period is not received within the period specified in the invoice, the Supplier shall have the right to suspend the use of Queast’s functionalities until the payment is received.
The User is responsible for ensuring that payments are made in full, without deduction, set-off, or withholding. Any bank fees, transfer costs, or similar charges shall be borne by the User.
The Supplier reserves the right, at its discretion, to introduce alternative or additional payment methods, including card payments through third-party payment service providers, without requiring an amendment to these Terms.
VII. Termination
VII.1. Termination by the User
The User may terminate the subscription for convenience at the expiry of each subscription period.
The User remains liable for all fees due and payable up to and including the effective date of termination.
If the User fails to pay in advance the applicable fee for any subscription period, the agreement under these Terms shall be deemed terminated automatically with effect from the end of the last pre-paid subscription period, without the need for further notice from the Supplier.
VII.2. Termination or suspension by the Supplier
The Supplier reserves the right to suspend or terminate the User’s access to the Platform, in whole or in part, with immediate effect and without prior notice, where the Supplier reasonably determines that:
- the User has breached these Terms or any applicable law;
- the User has failed to pay any undisputed fees when due;
- the User uses the Platform in a manner that exposes Queast to legal, regulatory or reputational risk.
Where reasonably practicable, the Supplier may provide the User with an opportunity to remedy the breach prior to termination; however, the Supplier shall have no obligation to do so where immediate action is justified.
VIII. Intellectual property rights
All intellectual property rights in and to the Platform, the Services, and all related components, including but not limited to software, source code, object code, databases, data models, algorithms, analytical methodologies, user interfaces, designs, documentation, trademarks, trade names, logos, and domain names, are and shall remain the exclusive property of the Supplier or its licensors.
Nothing in these Terms shall be construed as transferring or assigning any intellectual property rights to the User, except for the limited right to access and use the Platform expressly granted under these Terms.
The User shall not, and shall not permit any third party to, copy, modify, adapt, translate, distribute, sell, lease, sublicense, reverse engineer, decompile, or otherwise attempt to derive the source code, underlying ideas, or structure of the Platform, except to the extent expressly permitted by law.
The Platform may contain or provide access to content, data, or materials originating from third parties. All intellectual property rights in such third-party materials remain with their respective owners. The User acknowledges that use of such materials may be subject to additional restrictions imposed by the relevant rights holders.
IX. Personal data protection
More information on what categories of personal data we process, on what legal grounds, for what period we store them and your rights with respect to personal data processing can be found in our Privacy Policy.
X. Limitation of liability
To the maximum extent permitted by applicable law, the Supplier shall not be liable to the User for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business opportunities, loss of data, business interruption, or reputational damage, arising out of or in connection with the use of or inability to use the Platform or the Services, regardless of the legal basis of the claim.
Without prejudice to the foregoing, the Supplier shall not be liable for any damages, losses, claims, fines, or penalties arising out of or in connection with:
- the accuracy, completeness, timeliness, or reliability of any data, insights, or information made available through the Platform;
- any decisions, actions, or omissions taken by the User based on such data or insights;
- any AI-generated outreach messages or other AI outputs generated through the Platform;
- any outreach, communications, or marketing activities conducted by the User using information obtained through the Platform.
The User acknowledges that all data, insights and AI-generated outputs are provided for informational purposes only and that any reliance thereon is at the User’s sole risk and discretion.
The Supplier shall not be liable for any loss or damage arising from third-party content, data sources, or services made available through or referenced by the Platform, nor for the acts or omissions of third parties.
The availability of third-party content or services does not constitute endorsement, verification, or approval by the Supplier.
XI. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Bulgaria. The competent courts of Bulgaria shall have exclusive jurisdiction over any disputes arising from or relating to these Terms.

XIII. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure to enforce any right shall not constitute a waiver.
These Terms constitute the entire agreement between the parties concerning the Platform.
